
Practical Law has released a new standard document entitled Sample Procedural Order: Directions on Use of AI Tools in International Arbitration Proceedings. The publication provides a model procedural order that arbitral tribunals may use when issuing directions on the use of AI tools in international arbitration.
The sample order sets out possible directions that a tribunal may give to the parties and other participants in the arbitration, including witnesses, experts and the tribunal itself. Its purpose is to regulate the permissible use of AI tools within the proceedings and to provide clarity on acceptable practices.
In particular, the document includes sample language designed to establish transparency and disclosure requirements relating to the use of AI. These provisions aim to ensure that reliance on AI tools does not undermine procedural integrity or fairness in the arbitration process.
At the same time, the sample procedural order recognises the potential benefits of AI in international arbitration. It seeks to encourage the responsible use of AI tools to deliver efficiency gains and cost savings, while maintaining appropriate safeguards to protect the integrity of the proceedings.
